§ 1 Area of application

(1)These General Terms and Conditions of Use ("GTC") apply to the creation of a customer account ("registration") in our online store and the resulting contractual relationship in the version valid at the time of registration.

(2)The customer is a natural or legal person or a partnership with legal capacity who enters into a business relationship (customer) with the contractual partner (see § 2 of the GTC below) in the course of creating a customer account.

(3)The customer shall be informed of any amendments to the GTC no later than four weeks before they are scheduled to take effect. Amendments to these GTC shall only become effective for the customer if the customer agrees to them. If the customer does not agree to the changes, we shall be entitled to terminate the contractual relationship by giving two weeks' notice. The customer shall be informed of the individual changes and of the consequences of failure to consent. The customer's consent to the changes to the GTCs and compliance with the four-week notice period shall not be necessary if

• the changes are mandatory due to changes in the legal situation (legally binding case law, binding requirements of the legislator or binding official orders);

• the changes do not objectively lead to any disadvantage for the customer, i.e. the changes are to be regarded as advantageous or neutral from the customer's point of view.
  
  

§ 2 Contractual Partner

§ 3 Creation of a customer account

1. Registration takes place by means of e-mail verification. To create a customer account, you must click on the corresponding icon (  ), which you will find next to the shopping cart icon. In a next step you have to enter your e-mail address and confirm it by clicking the corresponding button ( Continue ). We will send you a login code to verify your e-mail address. It is valid for 15 minutes and can be used only once. In the last step you have to enter the login code and confirm it by pressing the corresponding button ("Submit"). By confirming the login code, the registration process is completed and the contract for the customer account is concluded. Immediately after registration you will get access to your customer account and will be redirected to the customer area.
2. By verifying your e-mail address, you confirm that

• You have your habitual residence in a country of the European Union, USA or Canada, in Australia or Japan,
• you are at least 16 years old

• you do not have any other customer account and

• in the case of legal entities, you have sufficient authority to represent them.
  
  

§ 4 Storage of the contract text

The text of the contract will be stored by us. You can view the GTC in our online store at any time and print and save them using your Internet utility (= browser).

§ 5 Term, deletion of the customer account

1. The contract is concluded for an indefinite period.
   
   
2. If you delete your customer account, you lose access to the customer area.
   
   
3. In the event that your customer account is deleted - at your request - by the contractual partner, you will lose access to the deleted customer account.
   
   

§ 6 Data protection

Information on the type, scope, location and purpose of the collection, processing and use of their required personal data can be found in our privacy policy, available in our Privacy Policy.

§ 7 Final provisions

1. Place of performance is Hall in Tirol, Austria.
   
   
2. Contract language is German.
   
   
3. This contract shall be governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. This choice of law shall only apply to the extent that the customer, who is a consumer, is not thereby deprived of the protection granted to him by the mandatory provisions of the state of his habitual residence. A consumer is any natural person who enters into a legal transaction for purposes that are outside his or her trade, business, craft or profession. An entrepreneur is a person for whom the transaction is part of the operation of his business.
   
   
4. If the customer is an entrepreneur, the exclusive place of jurisdiction for disputes shall be the court with subject-matter jurisdiction for 6060 Hall in Tirol, Austria. Entrepreneur is, for whom the business belongs to the operation of his business.
