Terms of Service (GTC)

§ 1 Scope and Provider

The following General Terms and Conditions (GTC) apply in the version valid at the time of the order to all orders placed by private customers (consumers) via the online shop 21rebel.store.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

By clicking the “Buy” / “Order with obligation to pay” button in the final step of the ordering process, you submit a binding offer to purchase the goods contained in the shopping cart.

The purchase contract is concluded when we accept your order through an order confirmation via email immediately after receiving your order, or when the payment is processed by the payment service provider you selected, whichever occurs first.
§ 3 Prices and Shipping Costs

The prices stated on the product pages include the statutory value-added tax (if applicable) and other price components.

In addition to the stated prices, we charge shipping costs for delivery. The shipping costs will be clearly communicated to you again in the shopping cart system and on the order page.

For deliveries to non-EU countries, additional customs duties, taxes, and fees may apply, which are to be borne by the customer.
§ 4 Payment Terms and Default

Payment can be made via PayPal or Bitcoin (cryptocurrency). Additional payment methods may be offered at checkout.

If the PayPal payment method is selected, the payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A.

In the event of default in payment by the customer, we are entitled to claim default interest at the statutory rate. We reserve the right to claim further damages caused by default.
§ 5 Delivery Conditions and Retention of Title

Delivery is available to the following countries and regions: North America (Canada, Mexico, United States), South America (Brazil, Chile, Guyana, Colombia, Paraguay, Peru, Suriname, Uruguay, Venezuela), and New Zealand. Deliveries to all other countries are currently not possible.

The delivery time results from the information in our Shipping Policy and on the respective product page. Since many products are manufactured “Print-on-Demand”, the delivery time also includes a production time of 2-5 business days.

The goods remain our property until full payment has been made.
§ 6 Right of Withdrawal
Consumers residing in the European Union have a statutory right of withdrawal. Details on this, including the conditions, deadlines, and the procedure for exercising the right of withdrawal, can be found in our separate [Right of Withdrawal / Cancellation Policy].
§ 7 Warranty (Liability for Defects)

The statutory warranty rights (liability for defects) apply.

Insofar as the delivered goods are defective, you are entitled, within the framework of the statutory provisions, to demand supplementary performance, to withdraw from the contract, or to reduce the purchase price.

For consumers in the EU, the statutory warranty period of two years from delivery of the goods applies.
§ 8 Liability

We are liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act. For slight negligence, we are liable for damages resulting from injury to life, body, and health of persons.

Furthermore, we are only liable for slight negligence in the event of a breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely. In this case, liability is limited to the typical, foreseeable damage.
§ 9 Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board. We prefer to clarify your concerns in direct exchange with you.
§ 10 Final Provisions and Applicable Law

The law of the State of Georgia shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Important note for consumers in the EU: This choice of law only applies insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence (favorability principle according to Art. 6 Para. 2 Rome I Regulation).

The contract language is English. In the event of deviations between the German and English versions of these GTC, the English version shall prevail for English-speaking customers.
