Terms of Service (GTC)

§ 1 Scope and Provider

  1. These General Terms and Conditions (GTC) apply, in the version valid at the time of the order, to all orders placed by private customers (consumers) via the online shop 21rebel.store.
  2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of Contract

  1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
  2. By clicking the "Buy" / "Order with obligation to pay" button in the final step of the ordering process, you submit a binding offer to purchase the goods in the shopping cart.
  3. The purchase contract is concluded when we accept your order by an order confirmation via email immediately after receipt of your order, or when payment is processed by the payment service provider you selected, whichever occurs first.

§ 3 Prices and Shipping Costs

  1. The prices stated on the product pages include statutory value-added tax (where applicable) and other price components.
  2. In addition, we charge shipping costs, which are clearly communicated again in the shopping cart and on the order page.
  3. For deliveries to countries outside the EU/EEA, additional customs duties, taxes and fees may apply and are borne by the customer (see our Shipping Policy).

§ 4 Payment Terms and Default

  1. Payment can be made via PayPal or Bitcoin (cryptocurrency). Additional payment methods may be offered at checkout.
  2. If PayPal is selected, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A. If Bitcoin is selected, payment is processed via our crypto payment service provider OpenNode.
  3. In the event of default, we are entitled to statutory default interest. We reserve the right to claim further damages caused by default.

§ 5 Delivery Conditions and Retention of Title

  1. Delivery is available to the EU/EEA, Switzerland, Australia, New Zealand, Japan, North America, Central America & the Caribbean, and South America. The exact list of deliverable countries is shown at checkout; deliveries to other countries are currently not possible.
  2. The delivery time results from our Shipping Policy and the respective product page. As many products are made "print-on-demand", the delivery time also includes a production time of 2–5 business days.
  3. The goods remain our property until full payment has been made.

§ 6 Right of Withdrawal

Consumers have a statutory right of withdrawal. Details, including the conditions, deadlines and the procedure for exercising it, as well as the model withdrawal form, can be found in our Right of Withdrawal / Cancellation Policy.

§ 7 Warranty (Liability for Defects)

  1. The statutory warranty rights (liability for defects) apply.
  2. If the delivered goods are defective, you are entitled, within the statutory provisions, to supplementary performance, to withdraw from the contract, or to reduce the purchase price.
  3. For consumers in the EU, the statutory warranty period of two years from delivery applies.

§ 8 Liability

  1. We are liable without limitation for intent and gross negligence and under the Product Liability Act. For slight negligence, we are liable for damages resulting from injury to life, body or health.
  2. Otherwise, we are liable for slight negligence only for the breach of a material contractual obligation (cardinal obligation); in that case liability is limited to the typical, foreseeable damage.

§ 9 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board; we prefer to resolve your concerns directly with you.

§ 10 Final Provisions and Applicable Law

  1. The law of Georgia applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. Important note for consumers in the EU: This choice of law applies only insofar as it does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country in which the consumer has their habitual residence (favourability principle, Art. 6(2) Rome I Regulation).
  3. These GTC are available in English and German. The English version is binding; the German version is a convenience translation.
